ARTICLE 1 PREAMBLE1:01 The purpose of this Agreement is to maintain harmonious and mutually beneficial relationshipsbetween the Employer, the employees and the Union, to set forth certain terms andconditions of employment relating to remuneration, hours of work, safety, employeebenefits, general working conditions affecting employees covered by this Agreementand to delineate the rights of the parties signatory to this Agreement.1:02 In the event that there is a conflict between the context of this Agreement and any regulations orpolicies made by the Employer, this Agreement shall take precedence over the saidregulations or policy.ARTICLE 2 MANAGEMENT RIGHTS2:01 The Union recognizes and agrees that all the rights, powers and authority both to operate andmanage the Town under its control and to direct the working forces is vestedexclusively with the Employer except as specifically abridged or modified by theexpress provisions of this Agreement.Should a question arise as to the exercise of management's rights being in conflictwith the specific provisions of this Agreement, failing agreement by the parties, thematter shall be determined by the Grievance and Arbitration Procedures.ARTICLE 3 DEFINITIONS3:01 Plural or Feminine Terms May ApplyWhenever the singular or masculine is used in this Agreement, it shall be consideredas if the plural or feminine has been used where the context of the party or partieshereto so require.3:02 For the purpose of this Agreement:(a) Bargaining Unit means the bargaining unit recognized in accordance withArticle 4.(b) Classification means the identification of a position by reference to a class titleand pay range number.(c) Council is the Council of the Town of Springdale.(d) Day of rest means a calendar day on which the employee is not ordinarilyrequired to perform the duties of his/her position other than:(i) a designated holiday(ii) a calendar day on which the employee is on leave of absence.(e) Day means a working day unless otherwise noted.
