1 2 3 4 5 6 7 DISCIPLINE NOTICE 8 WASHINGTON STATE BAR 9 In re WSBA FILE No. 10-01047 10 MICHAEL PRIMONT, RPC: 8.4 (c) - Dishonesty, Fraud, 11 Lawyer (BAR No. 20568) Deceit or Misrepresentation 12 Michael Primont (WSBA No. 20568, admitted 1991) of Seattle, was disbarred, effective 13 June 2, 2011, by order of the Washington State Supreme Court following approval of a 14 15 stipulation. Mr. Primont affirmatively admitted that if the matter were to proceed to a public 16 hearing, there is a substantial likelihood the Bar Association could prove by a clear 17 preponderance of the evidence the facts and misconduct, but did not affirmatively admit to the 18 facts and misconduct herein. This discipline is based on conduct involving immigration fraud. 19 According to the Stipulated Facts: 20 Since 2005, Amy Patricia Pasco has worked for Mr. Primont as a paralegal. Mr. Primont 21 paid Amy Patricia Pasco $7,000 to marry Hao Wang, an alien from China. On April 23, 2007, 22 Amy Patricia Pasco and Hao Wang were married in Las Vegas, Nevada. Mr. Primont was a 23 witness to their marriage. Section 245(a) of the Immigration and Nationality Act prohibits an 24 alien from seeking to procure a visa by fraud or willfully misrepresenting a material fact. On 25 December 17, 2007, Citizenship and lmmigration Services (CIS) officers conducted an WASHINGTON STATE BAR ASSOCIATION 1325 4th, Avenue Suite 600 Seattle, WA 98101-2539 1 unannounced visit to Amy Patricia Pasco’s residence in Kent, Washington. Amy Patricia Pasco 2 admitted that her marriage to Hao Wang was a sham, that the only purpose of the marriage was 3 to aid Hao Wang’s immigration case, and that Mr. Primont and Hao Wang were in a relationship. 4 On January 28, 2008, Amy Patricia Pasco filed for dissolution from Hao Wang and the 5 6 case concluded in May 2008. Amy Patricia Pasco withdrew her I-864 Affidavit of Support. In 7 May 2008, Mr. Primont and Hao Wang entered into a domestic partnership in Washington State. 8 In July 2008, Mr. Primont married Hao Wang in the State of California. In April 2009, 9 Hao Wang’s I-485 application to register permanent residence or adjust status was denied by CIS 10 on the basis of the fraudulent marriage. On November 18, 2010, the immigration judge accepted 11 a prehearing stipulation and granted Hao Wang voluntary departure to China in lieu of removal 12 on or before December 20, 2010. Mr. Primont’s conduct violated RPC 8.4(c), prohibiting a 13 lawyer from engaging in conduct involving dishonesty, fraud, deceit or misrepresentation. 14 Erica W.
